YOUR RIGHTS UNDER THE GDPR:
Upon request, your data held by us can be transferred to a third party.
Should you believe that the data held by us may be incorrect you can request that such incorrect data can be rectified.
Upon request, we shall erase all your data held by us. Subject to such data not being stored for operational requirements or due to legislation.
PROFILING AND FAIRNESS
Some of your data may be used for profiling. Profiling in this instance shall be limited to the statistics of the visitors to our website.
Upon request, you may request access to your data. Due to the sensitive nature of the same data, a request will have to be directed to our Data Protection Officer (DPO) to attend to your request.
Your data will only be processed in line with the remainder of this clause and for purposes stated herein.

ACCESS REQUEST PROCEDURE
ACCESS REQUEST FORM
In order to access records of STARRSTRUCK PTY LTD an access request form must be completed and submitted to STARRSTRUCK PTY LTD in accordance with the Promotion of Access to Information Act 2 of 2000 (The Act). It is important to note that the successful completion and submission of an access request form does not automatically allow the requester access to the record. An application for access to a record is subject to certain limitations if the requested record falls within the ambit specified within Part 3 Chapter 4 of the Act.
Please note that the Access Request Form must be completed in BLOCK LETTERS. If the requester is reasonably suspected of submitting false or misleading information in order to obtain records held by STARRSTRUCK PTY LTD, such a requester is susceptible to legal proceedings.
The completed Access Request Form must be sent via e-mail, fax or by registered post to the contact details referred to above.
In order to provide the requested records an Access Request Form will only be considered once a payment of the prescribed fees has been made (see prescribed fees below). Payment details can be obtained from the contact person as indicated. Should a request be reasonably refused, the payment made will be refunded to the concerned requester. The request fee payable by a requester, other than a personal requester, referred to in section 54(1) of the Act.
STARRSTRUCK PTY LTD will within 30 days of receipts of the request decide whether to grant or decline the request and give notice with reasons (if required) to that effect.
The 30-day period within which STARRSTRUCK PTY LTD has to decide whether to grant or refuse the request, may be extended for a further period of not more than thirty days, if the request is for a large volume of information, or the request requires a search for information held at another office of STARRSTRUCK PTY LTD and the information cannot reasonably be obtained within the original 30-day period. STARRSTRUCK PTY LTD will notify the requester in writing should an extension be sought.
7.5. GROUNDS FOR REFUSAL OF APPLICATION
Main grounds for refusal are but not limited to:
● Mandatory protection of the privacy of a third party who is a natural person, which would involve the unreasonable disclosure of personal information.
● Mandatory protection of the commercial information of a third party, if the record contains:
● Trade secrets of that party.
● Financial, commercial, scientific or technical information which disclosure could likely cause harm to the financial or commercial interests of that party.
● Information disclosed in confidence by a third party STARRSTRUCK PTY LTD if the disclosure could put that third party to disadvantage in negotiations or commercial competition.
● Mandatory protection of confidential information of third parties if it is protected in terms of any agreement.
● Mandatory protection of the safety of individuals and the protection of records which could be regarded as privileged in legal proceedings.
● The Commercial Activities of STARRSTRUCK PTY LTD which may include:
● Trade secrets.
● Financial, commercial, scientific or technical information which disclosure could likely cause harm to the financial or commercial interests of STARRSTRUCK PTY LTD.
STARRSTRUCK PTY LTD does not have internal appeal procedures. Therefore, the decision made by STARRSTRUCK PTY LTD is final. Requesters who are dissatisfied with a decision of STARSTRUCK PTY LTD will have to exercise external remedies at their disposal.
A requester or a third party, who is dissatisfied with STARRSTRUCK PTY LTD refusal to disclose information may within 30 days of notification of the decision, apply to an appropriate Court or Tribunal for relief.
